Data protection for website

1 Data controller

info@stiftung-jeder-mensch.de, hereinafter also referred to as the 'organiser', are responsible for the processing of personal data in the context of the competition.

2 Processing of data of participants and legal guardians

2.1 Collection and storage

When registering for the competition, we require and ask for the following personal data from the student: first name, surname and date of birth, school year, school, school location and an email address. It is mandatory to provide this information, and, without it, participation in the competition is not possible. We also ask for the student's gender, address, federal state and teacher and a telephone number. Providing this information is voluntary.

If the participant is not yet 18 years old, we will ask for the name of their parents and an email address so that we can identify them as legal guardians.

Competition entries that are submitted online as files are exported for judging and saved in a cloud for judging. The files are pseudonymised during the export. After the competition round, all exported files made available to the jury will be deleted from data storage media and the cloud.

The information collected during registration will be stored in a database of Glass Frog Films GbR and made available to Stiftung Jeder Mensch e.V. Only selected employees of Stiftung Jeder Mensch e.V., the film production company Glass Frog Films GbR, and Metamatics UG have access to the database. All employees are obliged to maintain confidentiality and to handle personal data with care.

2.2 Publication of personal data

The participants' data is initially only saved internally. All entries for the audience award will be published on YouTube. The YouTube channel is linked to the website. All posts on YouTube will be published with first name and age. If a participant wins a prize, their first and last name and their age and school, as well as their entry, will be published on the film competition website. Selected works will be published and disseminated in our own electronic media (e.g., videos), including via customary social media channels. The organiser also reserves the right to offer individual entries to selected media and institutions that have a particular interest in those entries, taking into account the specific task in question, for publication and dissemination.

At the request of the participant, the entry will be published anonymously. First names and age, as well as the relevant entry to the student film competition, will remain available on the website of the organiser and on YouTube until further notice, even after the competition has ended.

2.3 Purpose and legal basis of the data collection

We collect and process personal data of the participants in order to be able to carry out the student film competition in the form described and to be able to carry out the public relations work required for it. Under no circumstances will the data be used for commercial purposes.

We only collect and process personal data if we have been given the express permission to do so from the participant or legal guardian. As a rule, we obtain declarations of consent via our submission form. The legal basis for data processing is Article 6 para. 1 sentence 1 a) (Consent).

2.4 Duration of data processing, possibility of revocation

The participants' data will remain available on the organiser's website until further notice, even after the end of the competition. The provisions of Art. 17 para. 3 GDPR remain unaffected by this.

The data subjects can revoke their consent at any time, without needing to give reasons. Revocation of consent according to Art. 7 para. 3 GDPR.

3 Processing of teacher data

In order to implement the competition, it may be necessary for supervising teachers to enter themselves in the entry form. We ask for the following personal data in this regard: first name and surname, federal state, school, school location, email address (mandatory information) and telephone number (voluntary information).

We only collect and process personal data of the supervising teachers in order to be able to carry out the student film competition in the described form. Under no circumstances will the data be used for commercial purposes.

We only collect and process personal data to the extent that we have a corresponding declaration of consent for this from the supervising teacher. The data of the supervising teachers will be deleted after the competition has ended. The legal basis for data processing is Article 6 para. 1 sentence 1 a) (Consent).

4 Photos at events

Photos and film recordings are usually taken/made at award ceremonies and events. Sometimes, such photographs and recordings are later published in the context of the award ceremony. Participants who do not want to be photographed or who do not want the corresponding photographs or recordings to be published should make this known as early as possible. At the event itself, they should inform employees of the organiser or of the organising body or the photographer himself.

5 Obtaining rights of use

5.1 Entries with third-party content

Student works may contain content that is itself protected – for example, text, photos or images that originate from other people. In such cases, the consent of the relevant rights holder should be obtained, if necessary with the help of the supervising teacher. If this is not possible, the content in question should not be used. The intellectual property of others demands consideration and respect, and so copyrights must not be infringed in the competition entries. Responsibility for the content (images, audio clips, files, texts, music, etc.) of the entries is borne solely by the person submitting the entry, i.e., the student or legal guardian.

If the entry contains images of people, e.g., in photographs or in a video, then the granting of rights to the same extent includes the right to one's own image. No personal rights may be violated when depicting people. If one or more people are depicted in a work so as to be recognisable or appear in audio entries by third parties, those concerned must agree to the publication. The applicable declaration of consent must be presented to the organisers upon request, but these are only requested in exceptional cases.

6 Further offers of information

We reserve the right to send messages to participating students and supervising teachers. These notes only contain specific information about the registration and articipation procedure, as well as concerning the results of the competition round. The legal basis for data processing is Article 6 para. 1 sentence 1 a) (Consent).

7 Information about the collection of personal data and contact information of the controller

7.1 We are pleased that you are visiting our website and thank you for your interest. In the following, we will inform you about the handling of your personal data when using our website. Personal data refers to any data with which you could be personally identified.

7.2 The data controller who is responsible for data processing on this website within the meaning of the General Data Protection Regulation (GDPR) is the film production company Glass Frog Films GbR, email: datenschutz@aaandaction.eu. The data controller who is responsible for the processing of personal data is the natural or legal entity who alone or together with others decides on the purposes and means of processing personal data.

8 Data collection when visiting our website

For communication via the Internet (email): If you send us an email in order to contact us, the content of your email, the date, the time and your IP address will be saved on our mail server. The legal basis for this is the implementation of pre-contractual measures at your request in accordance with Art. 6 para. 1 b) GDPR. If you contact us to exercise your rights as a data subject, the processing of the above-mentioned data is based on Art. 6 para. 1 c) GDPR.

For event management: Information and personal data that you have given us when registering for an event – usually, your surname, first name, email address and event-related information, such as the selection of event blocks or meal requests – are stored for the duration of the organisation of the event and its follow-up. The data will be deleted no later than 24 months after the end of the event, unless there are legal reasons, e.g., accounting, which require the participant list to be stored for a longer period of time for documentation purposes. The legal basis for this is Art. 6 para. 1 sentence 1 b) GDPR.

For the operation of the websites www.aaandaction.eu, www.aaandaction.de and other language versions of the sites mentioned: Information that your browser automatically transmits to us in so-called server log files, including browser type/browser version, operating system used, referrer URL, host name of the accessing computer and time of the server request. The legal basis for this is Art. 6 para. 1 sentence 1 f) GDPR. Our legitimate interest in data processing lies in guaranteeing that a connection can be smoothly established and in evaluating the data for system security and stability.

9 Cookies

The internet pages sometimes use so-called cookies. Cookies are small text files that are stored on your computer and saved by your browser. Cookies do not damage your computer and do not contain viruses. Cookies serve to make our offer more user-friendly, more effective and safer; this represents our legitimate interest (Art. 6 para. 1 sentence 1 f) GDPR) in their use.

Most of the cookies we use are so-called 'session cookies'. They are automatically deleted after your visit to our site.

You can configure your browser to inform you about the use of cookies so that you can accept or reject cookies on an individual basis, can automatically accept cookies under certain conditions or always reject them, and can automatically delete cookies when you close your browser. When disabling cookies, the functionality of websites may be limited.

10 Contact

Personal data will be collected if you contact us (e.g., via contact form or email). The information collected in the case of a contact form can be seen from the contact form in question. This data is stored and used solely for the purpose of contacting you or to respond to your enquiry, and for the technical administration associated with this process. The legal basis for the data processing is our legitimate interest in responding to your enquiry in accordance with Art. 6 para. 1 f) GDPR. Your data will be deleted once your enquiry has been conclusively processed; this is the case if it can be inferred from the circumstances that the matter in question has been conclusively clarified, and provided that there are no legal retention obligations to the contrary.

11 Use of social media: videos

Use of YouTube videos

This website uses the YouTube embedding function to display and play videos from the provider 'YouTube', which is owned by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ('Google').

The extended data protection mode is used here, which, according to the provider, only triggers the storage of user information when the video(s) is/are played. If an embedded YouTube video is played, the provider uses 'YouTube' cookies to collect information about user behaviour. According to information from 'YouTube', these are used, among other things, to collect video statistics, to improve user-friendliness and to prevent abusive behaviour. If you are logged in to Google, your data will be directly associated with your account when you click on a video. If you do not wish to be associated with your profile when using YouTube, you must first log out before clicking the button. Google saves your data as usage profiles and evaluates them (including users who are not logged in). Evaluations of this nature are carried out, in particular, in accordance with Art. 6 para. 1 f) GDPR on the basis of Google's legitimate interest in the placement of personalised advertising, market research and/or demand-oriented design of its website. You have the right to object to the creation of these user profiles. You must contact YouTube if you wish to exercise this right.

Google LLC, based in the USA, is certified for the US-European data protection agreement 'Privacy Shield', which guarantees compliance with the data protection level applicable in the EU.

12 Rights of the data subject

You have the right to access information about your personal data (Art. 15 GDPR). You can also request the rectification (Art. 16 GDPR), erasure (Art. 17 GDPR) and transfer (Art. 20 GDPR) of your personal data.

You are entitled to object to the processing of your personal data (Art. 21 GDPR) or to request that processing be restricted (Art. 18 GDPR).

Insofar as you have provided your consent to us to process your personal data, you may withdraw this consent at any time with effect for the future.

You have the right to object, at any time, for reasons arising from your own particular situation, to the processing of your personal data carried out on the basis of Art. 6 para. 1 e) (public interest) or Art. 6 para. 1 f) (legitimate interest).

Right to object to direct marketing (Art. 21 para. 2 GDPR)

You may object to the processing of your personal data for the purpose of direct marketing at any time – without needing to give reasons.

You also have the right to lodge a complaint with a supervisory authority.

13 Duration of the retention of personal data

The duration for which personal data is stored is determined by the legal retention period in question (for example, retention periods under commercial and tax law). After the expiry of this period, the data in question is routinely deleted so long as it is no longer necessary in order to fulfil a contract or initiate a contract and/or there is no legitimate interest on our part to store it further.
